1. Acceptance of Terms
By creating an account or using MuslimsPay's website, mobile application, or related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
2. Description of Service
MuslimsPay provides a point of sale and business management platform for Muslim owned and Muslim serving businesses, including payment processing, inventory management, reporting, and integrated Islamic tools such as prayer time notifications, Qibla direction, Hijri calendar support, and Zakat calculation.
3. Eligibility
You must be at least 18 years old and have legal authority to act on behalf of the business you register to use the Service. By registering, you confirm the information you provide is accurate and current.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use of your account.
5. Fees and Subscription Plans
MuslimsPay offers the following plans, which may be updated from time to time with reasonable notice:
Free: Full point of sale functionality, ad free for the first 30 days. After the trial, the app remains free with advertising, or a one time payment of 4.99 USD (or local equivalent) removes advertising permanently.
Starter: 7 USD per month (or local equivalent), ad free, with core business tools.
Pro: 15 USD per month (or local equivalent), including advanced analytics, custom branding, and multi staff access.
A transaction fee of 0.5 percent applies to payments processed through the Service via our payment partners. This fee is charged only on completed transactions, meaning we earn only when your business earns, and is not linked to interest, penalties, or charges on idle balances. We intend for this fee structure to reflect Islamic principles of fair and profit linked compensation. We do not currently hold formal Sharia certification for this fee structure, and we encourage users seeking a religious ruling on its permissibility to consult their own qualified scholar.
6. Sadaqah Jariyah Option
Where available, you may elect to direct a portion of your transaction fee toward charitable causes as an ongoing Sadaqah Jariyah contribution. This feature is optional and does not affect the core functionality of the Service.
7. Payment Processing
Payments are processed through third party providers, including Stripe and regional payment rails such as Safepay, bKash, and Midtrans. MuslimsPay is not a bank or licensed financial institution. Use of payment processing features is also subject to the terms of these third party providers.
8. Acceptable Use
You agree not to use the Service to:
Violate any applicable law or regulation
Process fraudulent, illegal, or prohibited transactions
Interfere with the security or operation of the Service
Misrepresent your identity or business
Engage in transactions involving goods or services considered impermissible under generally recognised Islamic principles, where the Service is knowingly used for that purpose
9. Intellectual Property
The Service, including its software, design, trademarks, and content, is owned by MuslimsPay or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service except as permitted by law.
10. Termination
We may suspend or terminate your account for violation of these Terms, suspected fraud, or extended inactivity. You may close your account at any time by contacting us. Certain obligations, including payment of outstanding fees, survive termination.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error free operation. We make no representation that the Service, including its fee structure or Islamic tools, satisfies any particular religious ruling, and users should seek independent scholarly guidance where religious compliance is a determining factor in their use of the Service.
12. Limitation of Liability
To the maximum extent permitted by law, MuslimsPay and its officers, employees, and contractors are not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim is limited to the fees you paid in the twelve months preceding the claim.
13. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict of law principles, unless otherwise required by mandatory law in your jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
